ST. CLOUD -- A St. Cloud man made his first court appearance on charges he shot and killed a man outside the Sartell Sprint Store Thursday.

23-year-old Demetreus McGinnis has been charged with second degree murder in the death of 20-year-old Maurice Galvin Jr. Galvin was shot in the chest and later died at St. Cloud Hospital.

The judge ordered McGinnis held on $2,000,000 unconditional bail or $1,000,000 bail with court conditions.

The defense argued for $50,000 bail. They argued McGinnis was working at the Sprint Store Thursday when two men came to the store to rob him. According to the defense, Galvin pulled out a gun and threatened McGinnis. A struggle ensued and Galvin was shot in the chest.

But, Stearns County Assistant Attorney Will Brost says McGinnis was selling what is believed to be drugs and with his previous aggravated robbery convictions, there is a public safety concern because McGinnis qualifies as a dangerous offender.

McGinnis was returned to jail and his next court hearing has been scheduled for March 28th.

One side note, police still haven't found the gun used in the shooting.
