Lawsuit Over Flawed Background Check Proceeds

MINNEAPOLIS (AP) - A federal judge in Minneapolis has allowed a lawsuit over a false background check to proceed.

Mahlon Martin sued a background check company after he was fired from his job as a mortgage specialist at Wells Fargo.

First Advantage Background Services Corp. found Martin had been in jail 14 years earlier on a charge of impersonating an officer. Martin, in fact, had not been in jail for the misdemeanor and the case was dismissed a year later.

U.S. District Judge Michael Davis has ruled three of Martin's ten claims can go forward. First Advantage spokeswoman Lauren Kulik, in an email says her company has one of the strongest accuracy records in the industry.
