One of Two Colorado Teens Pleads Guilty in St. Cloud Sex Case
ST. CLOUD -- A teenager from Colorado has agreed to a plea deal involving sex with a 15-year-old girl last summer.
The Stearns County Attorney's Office says 18-year-old Wyatt Swindler has pleaded guilty to 3rd degree criminal sexual conduct for having sex with a girl older than 13 but younger than 16, and being more than 2 years older then the victim. In exchange for the plea, another criminal sexual conduct charge involving an impaired victim will be dismissed.
Swindler and Ryan Rees, who was 19 at the time, were accused of sexually assaulting the girl who was drunk and vomiting. Records show a friend of the victim confronted Swindler who admitted to having sex with the girl, but thought it was consensual and didn't know her age. Rees denied having any sexual contact with the girl when police interviewed him.
Swindler will be sentenced March 20th. According the plea agreement, Swindler will be sentenced to four days in jail, 41 days of home monitoring, must register as a predatory offender, and be on probation for five years.
Rees has a settlement conference scheduled for next Monday.
