FOLEY -- A St. Cloud man has reached a plea agreement this (Tuesday) morning in a fatal drug overdose case.

60-year-old Marvin Davis pleaded guilty to a 3rd Degree Controlled Substance Crime. Benton County Attorney Phillip Miller says Davis admitted to Judge Robert Raupp that he gave crack cocaine to Shiquita Clark last September, knowing she had ingested heroin, was in medical distress and had difficulty waking up or staying awake.

Clark later died at Davis’ St. Cloud apartment. The Medical Examiner determined Clark's cause of death to be 'mixed drug toxicity' from a combination of heroin and crack.

As part of the plea agreement Davis was given credit for the 209 days of jail time already served, ordered to comply with mental health and chemical dependency evaluations, abstain from all mood altering chemicals and to follow specific directions of any perscription medications.
