MINNEAPOLIS (AP) - A grand jury has declined to indict a St. Louis Park police officer who fatally shot a man while off-duty last year.

The grand jury determined that Officer John Herman acted within the law when he killed 29-year-old Jason Anthony Martin in November 2009.

Herman was off-duty and in his private vehicle when he encountered a pickup being driven erratically and carrying Martin as a passenger.

Both vehicles stopped. Herman then scuffled with "at least one of the occupants," and Herman shot Martin.

The Star Tribune reports authorities would not say whether Martin was armed or what sparked the altercation.

Herman has since returned to work.
