Man Sues Prison System After Being Held 13 Months Too Long
MINNEAPOLIS (AP) -- A 33-year-old man is suing the federal Bureau of Prisons for leaving him imprisoned in Rochester for an extra 13 months.
Jermaine Hickman, who was convicted in 2007 of bank robbery, had a calculated release date of October 11th, 2012 from the Federal Medical Center.
He walked free on November 21st, 2013.
Prisons spokesman Ed Ross called the incident "a very rare occurrence" but declined to comment specifically on Hickman.
In responses filed recently by an assistant U.S. attorney in Minneapolis, the government implies that it was Hickman's responsibility to inform the bureau when he should have been released.
Under federal law, Hickman, who now lives in Omaha, Nebraska, is entitled to up to $500,000 in damages if the bureau is found liable for wrongful imprisonment.
