I have seen/heard about some lawsuits that people have filed that seem absolutely nuts.  And I often wonder why anyone would take the case.  Generally, when you take a case, you feel that it is a winable case.  Otherwise, why would you want to take a loser case.  So, I blame the attorney as well as the person or people who are bringing the lawsuit.

This time, it's against Reese's/Hershey regarding their seasonable pumpkins.  Those delicious little chocolate peanut butter pumpkins.  Now, when i read that there was a lawsuit, I guessed that it was because someone found something harmful in the pumpkins.  Like metal, or ecoli or some other "thing" that one should not consume.  Nope!  That was incorrect.  The "shocking" lawsuit comes along because the pumpkins do not have faces.  (insert eye roll)

The packaging includes a pumpkin with a face on it, like a jack-o-lantern. When you open the package, the pumpkin is just basically a Reese's peanut butter cup shaped like a pumpkin with no face on it.  4 people are suing because of their "extreme disappointment".  Oh, and they are also suing for $5 million dollars.  Even if you were disappointed, how do you justify $5 million dollars?! There is no way that actually affected their life in any sort of significant way.  And if you were affected by a chocolate peanut butter pumpkin in that way maybe the call you should have made was to a therapist and not to an attorney.  Just my opinion.

The lawsuit is claiming false advertising.  I guess that could be true.  Personally, I would say "Oh, bummer" and just move on, but I'm not everyone, obviously.  But this still just looks like an opportunity for a cash grab.  What's wrong with people?  You can check out the details of the lawsuit here.

Also - those seasonal chocolate peanut butter pumpkins are already available.  A full 3 months ahead of Halloween.  But, as for right now, only available online.  Not in stores quite yet, but soon.  You can order a 32 ounce bag for $25 through the website.  And also, apparently now they will have a face on them.
