Judge: Ruling Within 90 Days on Child Care Vote
ST. PAUL (AP) – A Ramsey County judge says he’ll decide within 90 days whether Minnesota child care workers can proceed with a vote to unionize.
Judge Dale Lindman said he will consider arguments from child care providers who oppose the vote and from Gov. Mark Dayton, who late last year called for the vote by executive order.
Lawyers for 11 plaintiffs argued that Dayton overstepped his authority with the order. Solicitor General Alan Gilbert argued that Dayton acted appropriately because it would up to the Legislature whether to approve any agreements with a union.
The union vote would affect 11,000 in-home child-care providers, but only about 4,300 providers – those who get state money to care for children from poor families – would have been eligible to vote.
