MINNEAPOLIS (AP) - Hennepin County Attorney Mike Freeman won't seek felony charges for the driver who plunged into a St. Louis Park retention pond last November, killing two children.

Marion Noel Guerrido had five children with her on Nov. 21 when she lost control on the ramp from Highway 7 to Highway 100 and drove into the pond.

Seven-year-old Alarious Guerrido and 5-year-old Zenavia Rennie did not survive.

Freeman says the crash was a horrible tragedy and there is nothing the criminal justice system can or should do about it.

The investigation showed Guerrido wasn't speeding, wasn't using drugs or alcohol, and wasn't on her cell phone.

However, she had a learner's permit, not a license. It's not immediately clear whether she'll be ticketed for driving without a licensed driver in the vehicle.
