Judge: Duluth Head Shop Owner to Stay in Jail

MINNEAPOLIS (AP) - The owner of a Duluth head shop who was convicted of selling synthetic drugs won't get out of jail before his sentencing.

Jim Carlson is awaiting sentencing on 51 felony counts including misbranding of synthetic drugs, conspiring to distribute them, and money transactions derived from their illegal sale.

Reports say his attorney Randall Tigue filed a motion to release Carlson before his sentencing. But U.S. District Judge David Doty issued an order Wednesday saying that Carlson must remain in jail.
 
 
 
Tigue also filed motions for acquittal and a new trial. Those are expected to be the basis for a subsequent appeal to the U.S. 8th Circuit Court of Appeals. No sentencing date has been set.
