MINNEAPOLIS (AP) - A Hennepin County prosecutor says the wife of a former Minnesota Vikings player told her daughter she had been drinking before she struck and killed a man on an interstate ramp.

Assistant Hennepin County Attorney Deborah Russell made the comment during arguments Monday to dismiss a third charge of criminal vehicular homicide against Amy Senser. Prosecutors recently added the charge, but the defense argued there isn't enough evidence to support it.

Russell's comment is the first time the state has said a family member claimed Senser talked about drinking the night Anousone Phanthavong was killed last August while filling his gas tank with fuel on the ramp.

The defendant, who's married to Joe Senser, is scheduled to go on trial Monday.
