MINNEAPOLIS (AP) - Misdemeanor charges have been filed against a driver who plunged into a retention pond in Hennepin County last November, killing two children and injuring three others.

St. Louis Park prosecutors have charged 23-year-old Marion Guerrido with driving without insurance, violating the requirements of her learner's permit and failing to properly use child safety restraints.

Guerrido was driving the five children from her blended family when she lost control on a wet road, overcorrected and slid into the pond. Last month the Hennepin County attorney's office declined to file felony charges against Guerrido, who prosecutors say wasn't speeding, using a cellphone or doing anything else that would have constituted a felony.

A family attorney, Rick Perry, says the three surviving children are doing pretty well and are back at school.
