HASTINGS (AP) - The man convicted of killing a Mendota Heights police officer wants the cash that was taken from him at the time of his arrest.

Attorneys for Brian Fitch have filed a motion in Dakota County seeking the return of nearly $3,000 that was found in his pants when he was taken into custody in St. Paul last July. Fitch is serving a life prison sentence for fatally shooting Officer Scott Patrick in West St. Paul.

Fitch's attorneys say law enforcement did not filed a timely notice of forfeiture for the cash. Fitch's lawyers conceded during his trial that he was a drug dealer and had spent the day before his arrest collecting money owed him.
