ST. PAUL (AP) - The man charged in the killing of Mendota Heights police Officer Scott Patrick will likely stay hospitalized into next week.

Brian George Fitch Sr. was shot eight times by police on July 30, after authorities say he fired at them. The shootout happened in St. Paul, hours after Fitch allegedly gunned down Patrick during a routine traffic stop in West St. Paul.

Fitch was due to appear in Dakota County District Court on murder charges on Monday. But court documents say it appears he'll still be hospitalized.

His first court appearance has been postponed until he is discharged from the hospital.
