AITKIN (AP) - Aitkin County's sheriff says the man charged with kidnapping and terrorizing his wife was not under arrest when he grabbed a deputy's gun at a St. Cloud hospital and fatally shot him.

Sheriff Scott Turner says Danny Hammond was going to be arrested when he was cleared to leave the hospital. Hammond had been charged six days earlier with numerous felonies after he was accused of threatened to kill his wife at gunpoint and wouldn't let her leave their home.

The Minnesota Bureau of Criminal Apprehension says Hammond was not in handcuffs when he struggled with Deputy Steven Sandberg and killed him. Hammond died after he was subdued with a stun gun. Turner says a suspect's need for medical help can take priority over an arrest. Authorities say a suicide attempt put Hammond in the hospital.
